Please read this Terms and Conditions carefully prior to participation or entry. No purchase or payment of any kind is necessary to enter or win. 

Sponsor

The Bank of America Chicago Marathon Sweepstakes (the "Sweepstakes") is sponsored and administered by Shokz Technology Inc. ("Sponsor").
This Sweepstakes is not sponsored, endorsed, or administered by any marathon organizer or social media platform.

Eligibility

This Sweepstakes is open to individual legal residents of the 50 United States or the District of Columbia. Participants must be of legal age (generally at least eighteen (18) or the age of majority in their jurisdiction of residence) to enter into a binding agreement to take part in this Sweepstakes.

Employees, officers, directors, representatives, agents, and contractors of Sponsor and its affiliates, subsidiaries, advertising agencies, and promotion agencies, as well as their immediate family members and household members, are not eligible to participate.

Void where prohibited by law.

Sweepstakes Period

The Sweepstakes begins on September 23, 2026 at 00:00 CDT and ends on October 11, 2026 at 24:00 CDT (the “Sweepstakes Period”). All entries must be received during the Sweepstakes Period.

How to Enter

No purchase is necessary to enter or win.
Entries are submitted by providing an email address in the designated field at the top of the landing page.

Prize(s)

The giveaway prize includes three (3) Co-Branded Edition OpenRun Pro 2 headphones, five (5) OpenRun Pro 2 headphones, twenty (20) Shokz tote bags, and thirty (30)  foldable water bottles.

Prizes are non-transferable and not redeemable for cash except as required by law. Sponsor reserves the right to substitute a prize of equal or greater value if necessary.

Winner Selection and Notification

Participants must sign up via shokz.com in order to enter or receive a prize. Each participant has a maximum of one (1) chance to win when entering a Sweepstakes. Odds of winning depend on the total number of eligible entries. Potential winner(s) will be selected at random from among all eligible entries received.
 
Winners will be notified via email and must respond within seven (7) days to claim the prize. Failure to respond within this period will result in automatic forfeiture of award eligibility.

Assumption of Risk and Release

BY PARTICIPATING IN THIS SWEEPSTAKES, EACH PARTICIPANT AGREES TO RELEASE, INDEMNIFY, AND HOLD HARMLESS SPONSOR, ITS AFFILIATES, SUBSIDIARIES, ADVERTISING AND PROMOTION AGENCIES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND REPRESENTATIVES (COLLECTIVELY, THE "RELEASED PARTIES") FROM ALL CLAIMS, DAMAGES, LOSSES, COSTS, AND EXPENSES (INCLUDING ATTORNEYS' FEES) ARISING FROM PARTICIPATION IN THE SWEEPSTAKES, ACCEPTANCE OR USE OF THE PRIZE, OR ATTENDANCE AT THE EVENT.

ASSUMPTION OF RISK: THE WINNER ACKNOWLEDGES THAT PARTICIPATION IN A MARATHON INVOLVES INHERENT RISKS, INCLUDING INJURY, ILLNESS, DISABILITY, OR DEATH. THE WINNER ASSUMES ALL SUCH RISKS AND AGREES THAT THE RELEASED PARTIES ARE NOT LIABLE FOR ANY INJURY, LOSS, OR DAMAGE FROM THE EVENT. SPONSOR DOES NOT PROVIDE ANY INSURANCE OR MEDICAL COVERAGE FOR THE WINNER.

Limitation of Liability

IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THIS SWEEPSTAKES OR THE PRIZE.

Privacy

Personal information collected in connection with this Sweepstakes will be processed in accordance with Sponsor's Privacy Policy and applicable United States federal and state privacy laws. Such Information collected will be used for Sweepstakes administration, winner fulfillment, and related business purposes. By entering the giveaway with your email, you will automatically subscribe to Shokz's email service. For details about how Shokz protects your data, please refer to the Shokz Privacy Policy.

Email subscription users have the right to unsubscribe from our marketing communications at any time. To opt out of receiving promotional emails, a user may click the unsubscribe link provided at the bottom of any email message from Shokz, or contact Shokz at privacy@shokz.com to discontinue receiving such communications. To opt out of text (SMS/MMS) messages, a user may follow the instructions included in any message received from Shokz, or contact Shokz at privacy@shokz.com.

Please note that opting out or unsubscribing from marketing communications will not prevent a user from receiving non‑marketing communications, such as messages regarding orders, products, or other important notices, including changes to terms and policies.

Additional Terms

All federal, state, and local laws and regulations apply. Shokz reserves the right to cancel, terminate, modify or suspend the giveaway should a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security fairness or proper conduct of the giveaway. Shokz reserves the right to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the giveaway or who violates these giveaway rules. Shokz shall not be liable for a Winner's failure to receive notification due to the email being directed to spam, junk, or other filters, or for any incorrect or non-functional contact information provided by the Winner.

Governing Law

This Sweepstakes and these Official Rules shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of laws principles.
